These are the terms and conditions for the following sites – isoskills.ro and isoskills.fi (the “Site”), which introduce the services that the IsoSkills Group of companies provide worldwide through its member companies registered in Romania and Finland, their affiliates and their associated entities.

By using this Site, you are agreeing to the following terms and conditions.

 

User Acceptance

IsoSkills Group is formed of: IsoSkills Group SRL with headquarter in Bucharest, District 1, Calea Floreasca Street, No. 169, Building X ”Floreasca CUBE-BUSINESS HUB2”, 5C, Floor 2, registered at Trade Register with no. J40/16676/2017, identification code of registering RO38292530 and IsoSkills Oy, with headquarter in Espoo Regus Center, 3rd floor, Metallimiehenkuja 10, 02150 Espoo, Finland. The Site is jointly owned and administrated by IsoSkills Group SRL and IsoSkills Oy hereinafter collectively named “The Company”.

The Company may revise this document at any time by updating this page. Please visit this page periodically to read the “Terms and Conditions” as this document is legally binding. Your continued browsing and use of the content The Site represents your acceptance of the amendments to these Terms and Conditions.

These Terms and Conditions applies to all the Company’s websites, company and services presentation. The Site, company and services presentation as well as Career section are offered to you conditioned by your acceptance without modification of the terms of this contract. To ensure compliance with the present terms and conditions of access, all Users must read the present Terms and Conditions of use each time they access The Site. Even if you fail to review the Terms and Conditions but you visit and use the information from The Site or apply to a role posted in Careers section of the above-mention website, we will consider that you have accepted this set of Terms and Conditions (including any updates thereto), unless, exclusively for the relevant reference period, usage is governed by specific rules that have been hereby expressly communicated to you.

If you do not agree with the provisions of this set of Terms and Conditions (including any updates thereto), please do not use or, if applicable, discontinue using the Site.

Users that apply to job openings from Career section, are allowed to do so only if they are at least 16 years old at the time of applying to a job opening. Accessing and applying at job openings from Career section from The Site is not permitted for individuals under the age of 16.

2. Description of usage

2.1.      The User’s obligations regarding the use and access to the functionalities of The Site

2.1.1.   to update the data they provided to the Company at the time of placing the CV in the Carrer section, using all available options in the Site;

2.1.2.   use the functionalities of the Site in a way that does not interfere with the normal functioning of the Site and in accordance with the legislation in force and with these Terms and Conditions

2.1.3.   not to carry out computer activities or any other activities that are aimed at obtaining information not intended for him/her, including data of other Users or that interfere with the principles or technical aspects of the functioning of The Site;

2.1.4.   To take all security measures regarding the use of the Site. Disclosure of the password to access the user account is not permitted and it is recommended to use a strong security password (e.g. containing at least eight characters, including uppercase letters, lowercase letters, digits and special characters).

2.2.      The User agrees not to engage in any of the following prohibited activities:

2.2.1.   avoiding, disabling, disabling, altering or degrading any means of protecting the content of the Site;

2.2.2.   downloading, storing, capturing, reproducing, copying, archiving, distributing, transmitting, uploading, uploading, publishing, modifying, creating derivative works from, or translating the content of the Site or any portion thereof, other than as expressly permitted by the Company;

2.2.3.   attempting to gain unauthorized access to the Site, the server on which the Site is stored or any other server, computer or database connected to the Site;

2.2.4.   attacking the Website through a DoS (“denial of service”) or DDoS (“distributed denial of service”) attack;

2.2.5.   introduction of viruses, Trojan horses or any other technologically harmful material;

2.2.6.   sending or posting any unsolicited advertising, marketing, unsolicited promotional material on or through the Site.

2.2.7.   use the Site for commercial purposes other than those expressly permitted by the Terms and Conditions;

2.2.8.   collecting personal data from the Site using them for any other purposes other than those expressly permitted by the Terms and Conditions;

2.2.9.   it is forbidden to submit materials or to post messages or to display attitudes that could cause damage or jeopardize the image of a person or organization, pornographic, offensive, vulgar, vulgar language, inciting to violence, spam or containing viruses, etc., material that promotes discrimination on any ground or that is published in breach of obligations to third parties (such as, for example, an obligation of confidentiality), material that promotes illegal activities, threatens, abuses or invades another person’s privacy or causes annoyance anxiety or cause inconvenience to another person, which are likely to harass, upset, alarm any other person, which may be used to impersonate another person or which misrepresent another person’s identity or affiliation to third parties, material which gives the false impression that it emanates from the Company

The Site gives users access to a rich collection of customized content, resources and online career tools including jobs and business articles. You understand and agree that The Site includes various service presentation and business articles.

We use personal information to establish and improve our relationship with you, including:

• Operating and maintaining the website
• Preventing fraud and abuse
• Customizing and displaying content
• Communicating about our products and services
• Responding to inquiries and customer service requests
• Monitoring site usage trends

We use Google Analytics to analyze site usage and collect aggregate data for business decisions. You can review Google’s privacy practices at Google Analytics Privacy.

Users are prohibited from submitting unlawful, defamatory or obscene material.

3. Intellectual Property Protection

The content of The Site (as well as any other material related to the Company, such as articles, design, newsletters, and any other materials hereinafter referred to as “The Site Content”) belongs to The Company and its collaborators and is protected by intellectual property law. Articles published in dedicated content pages (e.g., Portfolio, Insights, etc.) may not be created by The Company; however, the intellectual property rights related to them belong exclusively to The Company.

The Company authorizes you to view and download a single copy of the material from The Site only for personal and non-commercial use. The content of this website, texts, graphics, photographs, software and other materials are protected by copyright. The entire material is owned by The Company. The compilation (adding and rearranging) the content of this website is the exclusive right of the Company, right protected by law. Unauthorized use of the material is a violation of copyright law or other laws. You may not sell or modify the material, exhibit or use it in any other way for public or commercial reasons.

You may not reproduce or allow anyone to reproduce these materials without written permission from The Company, which holds the intellectual property rights over the respective content section of isoskills.fi. Additionally, it is prohibited to reproduce, in whole or in part, the information contained in the content pages of this website and in the recruitment announcements of The Company, without prior written consent from The Company.

The following actions are not permitted without obtaining prior written permission from The Company:

1. Reproducing or storing content, as well as transmitting this content to any other website, server or any other information storage medium,
2. Modifying, publishing, transmitting or participating in the transfer, sale or distribution of materials created by reproducing, modifying or displaying the content without prior written permission from The Company,
3. Removing signs that indicate The Company’s intellectual property rights over the content.

On servers that are owned or leased by The Company any unauthorized user access is prohibited. In case of trial and/or access these servers without right, the act constitutes an offense punishable under Romanian legislation.

Any use of the content of The Site for purposes other than those expressly permitted by this document is prohibited. Requests for the use of content for purposes other than those expressly permitted in this document may be sent to the email address: office@isoskills.fi.

Furthermore, the use of automated means, including scripts, robot applications, bots, spiders, crawlers and/or any other applications/software that may deceive or simulate job applications or exploit any functions or vulnerabilities of The Site to gain advantages for oneself, other Users or third parties concerning the use of The Siteor access to and use of any content or information from this website is strictly prohibited.

By submitting materials, including CVs on The Site, and by giving your consent on the Site, you agree to give permission to The Company to use the materials and also to:

• copy, distribute, transmit, reproduce and translate;
• mention your name in connection with the material you have submitted;
• assign these rights to any partner of The Company.

You are not entitled to any compensation for the material use in the manner described above. The Company has no obligation to post on the website or use in any way the material provided by you. The Company also has the right to delete your material at any time, without needing a reason to do so.

            The user is prohibited:

• To copy, reproduce, reproduce, take, take, transmit, transmit, publish any part or fragment of any of the materials (course materials, printed materials, flyers, information, in any medium whatsoever) related to the Services and/or to support or collaborate with third parties to reproduce any part or fragment of such materials for any purpose other than those expressly permitted in these Terms and Conditions;

4. Information for Career section applications

When you apply for a career job posted or for newsletter, we will request certain information including a valid email address. In addition to the terms and conditions that will be governed in site policy, you understand and agree that The Site may disclose to third parties certain aggregate information contained in your registration application. The Company will not disclose to any third party your name, address, email address or your telephone number without your consent, except as required by law, when disclosure of such information is required. In this case, the Privacy Policy applies

5. Limitation of Liability

Affirm that you acknowledge and you agree that The Company will not be liable for any direct, indirect, incidental damages, including unreached profits, using possibilities or other damages (even if The Company has been advised of the possibility of appearing such damages), resulting from:

• the use of the business content listed on isoskills.fi (The Site);
• statements or actions of any Company business partner on site`s Career postings;
• any other problem relating to site`s content company or services presentation.

Declare that you understand and you agree the following statement:

1. any material downloaded or obtained in another way by using isoksills.fi provided by The Company can be used only at your own risk and you are the only person responsible for;
2. any damage caused or data loss that may result from the download or use of such content is not The Company responsibility.

            The Company shall not be liable for any errors in the display of the features of the Services. The Site content, features, functions, services and information contained therein are provided on an “as available” basis.

            The Company makes no warranty that the features of the Site and the services will meet the user’s desires or that the results obtained from the use of the Site will be correct or meet the user’s desires. The Company will use reasonable efforts to ensure that the Services are uninterrupted, provided on a timely basis, and that errors are corrected as soon as possible.

            The Company does not warrant that the Site, the servers on which it is hosted or the e-mails sent by the Site are free of viruses or other potentially harmful computer components, that it is free of errors, omissions, defects, delays or interruptions in operation or transmission, line failures or any other similar factors with disruptive effect, including interruptions in the provision of domain hosting, web hosting, database, e-mail services, internet access services. The User uses the Site at his/her own risk, the Company being exonerated from any liability for any direct or indirect damage caused by the use or access/visitation of the Site or as a result of the use of the information on the Site. The Company shall not be liable for any errors or omissions that may occur in the editing or presentation of the materials on the website. In such cases, the User shall notify the Company by telephone, and the Company will try to remedy the deficiencies within a reasonable time.

            Any links to other sites are provided solely for the purpose of increased accessibility of information, and the Company has no responsibility or liability for the content of these sites, the Services or services promoted or marketed through these sites.

            The Company shall not be liable for damages caused as a result of: (i) the Site not functioning, as well as (ii) those resulting from the impossibility to access certain links published on the Site, (iii) virus attacks, cyber-attacks of the DoS type (“denial of service”, in English: “denial of service”) or attacks with and by other computer-damaging tools, which may damage your computer equipment, computer programs, data or any other material in connection with or resulting from your use of the Website or downloading content from the Website or originating from a link to which the Website refers.

            The Company shall not be liable for (i) any direct or indirect damage which the User has suffered or may suffer, which damage could not have been foreseen by the Company at the time of use of the Services; (ii) any direct or indirect damage/loss that the User may suffer as a result of failure to comply with these Terms and Conditions (iii) commercial losses, including loss of revenue, profit or savings that the User has suffered or may suffer as a result of using the Services.

            In each case concerning the determination of the liability of the Company, its employees, its authorized representatives and/or its agents, the liability towards the User, irrespective of its legal basis, shall be limited to the amount of the Distance Contract Price.

            The Company is not responsible for online, bank or cash payment transactions carried out by third parties, who are responsible for the accuracy and security of the Transactions carried out.  

6. Availability of the Services

The Company reserves the right to modify website content or discontinue service availability without prior notification. The company is not liable for any consequences arising from such modifications.

7. General terms

            These Terms and Conditions shall be governed by and construed in accordance with Romanian law.

            The parties shall use their best efforts to settle amicably any dispute. The User will receive the Seller’s point of view/answer within 30 days from the date of receipt of the written request sent by post or email to any of the contact details in the Contact section

            If an amicable settlement is not possible, the dispute will be referred to the competent courts in Romania, without this restricting the right of the consumer User to resort to alternative dispute resolution by accessing the portals http://ec.europa.eu/consumers/odr/ and/or www.anpc.ro.

If any provision of this section “Terms and Conditions” is considered invalid by the legal forums, the invalidity of such provision will not affect the validity of the remaining provisions of the “Terms and Conditions”, which remain in force. These “Terms and conditions” fully represent an agreement between you and The Company regarding the use of the site isoskills.fi. These conditions can be modified by us from time to time without prior notification or acceptance from users. You can review the most current version of these Terms anytime by visiting this page.

This Agreement constitutes the only convention between you and The Company and governs your use of the website services isoskills.fi, imposing itself over any previous agreement between you and The Company or its site (including but not limited to a previous version of the Regulation).

Rules and relationships between users and The Company will be governed by the applicable laws in Romania.
